1. Information on how to enter and prizes form part of these terms and conditions (“Conditions of Entry”). Any entry not complying with the Conditions of Entry will be deemed invalid and rejected. Submission of an entry is deemed acceptance of the Conditions of Entry.
2. Entry is only open to residents of Australia, aged 18 years and over. Employees of the Promoters, and their immediate families and agencies associated with the [name of competition] promotion (“Competition” or “Promotion”) are ineligible to enter.
3. The competition commences at midnight AEDST on 20/05/11. Entries close at midnight AEDST on 20/07/11 (“Competition Period”). Promoter reserves the right to extend or shorten the Competition Period.
4. To enter, complete the questions and follow the instructions in the Entry Form. Entrants must submit an original literary work consisting of 25 words or less (“Work”) as part of their entry.
5. Entrants must accurately submit their name and address. The Promoter reserves the right to disqualify any entrant who submits an entry that is not in accordance with the Conditions of Entry or for a purpose or in a manner other than that disclosed by the materials published by the Promoter. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Incomplete, indecipherable or illegible entries will be deemed invalid.
6. The prize consists of 5 VS Sassoon brush Prize packs each valued at $49.95 to the total value of $249.75.
7. This competition is a game of skill. Chance plays no part in determining who is selected as the winner. All valid entries received during the Competition Period will be individually judged based on literary and creative merit and originality of the Work. Judging will take place at the Promoter’s premises. Winners will be notified by email or telephone using contact details provided in their entry.
8. Prizes do not include any ancillary costs associated with redeeming the prize. These are the responsibility of the winners. Selection of prizes (including but not limited to colours, designs, style, size and material) will be determined by the Promoter in its complete discretion.
9. Except for any liability that cannot be excluded by law, the Promoter (for itself and on behalf of its affiliates and the officers, employees and agents of all of the foregoing (each a “Covered Party”) excludes all liability, for any personal injury; or any loss or damage (including loss of opportunity); howsoever caused (including as a result of negligence of any Covered Party) whether direct, indirect, special or consequential, arising in any way out of or in connection with the Promotion, including, but not limited to, any of the following: (a) any technical difficulties or equipment malfunction (whether or not under the control of a Covered Party); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after its receipt by a Covered Party) due to any reason beyond the reasonable control of a Covered Party; (d) any variation in prize value to that stated in the Conditions of Entry; (e) any tax liability incurred by a winner or entrant (f) redemption of the prize and/or (g) participation in this promotion.
10. On submission of each entry the entry form becomes the property of the Promoter and the entrant grants to the Promoter an irrevocable, perpetual, worldwide, royalty free, non-exclusive licence in the copyright in the Work to use the Work in any media for any future promotional, marketing and publicity purpose without any further reference or payment or other compensation to the entrant. The entrant consents to any act or omission that would be a breach of his or her moral rights in the Work.
11. Promoter’s decision in relation to all aspects of the Competition is final and binding on all who submit entry forms and no correspondence will be entered into.
12. In the event that the prize is unavailable despite the Promoter’s reasonable endeavours to procure the same within Australia, the Promoter reserves the right to substitute a different prize item of equal or greater value.
13. By submitting an entry form, unless otherwise advised by the entrant, each entrant consents to the information they submit being used by the Promoter in any media for any future promotional, marketing and publicity purpose. The collection, use and disclosure of personal information provided in connection with the Competition is governed by the Privacy Notice.
14. The Promoter reserves the right to refuse to allow any entrant or person associated with an entrant to take part in any or all aspects of the prize presentation, if the Promoter determines, in its absolute discretion, that any such person is not mentally or physically able to participate safely or on a reasonable basis.
15. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by that winner.
16. Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for the consequences of any information supplied by an entrant that is incorrect, inaccurate or incomplete or any error in or corruption of that information occurring during transmission. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person’s handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in the Competition.
17. By entering the Competition, the entrant consents to receiving any email or other communication regarding the Competition, or which inform the entrant of the Promoter’s other publications, products, services and events and to promote third party goods and services that the Promoter considers the entrant may be interested in.
